 Questions We have posed for Ourselves to Build Our Case under the Indian and Public Trusts.

PART 1 stay tuned for part 2 😉 Each Question will be its own individual part. I encourage you to follow us on our path to bring this case forward to the courts. Accomplishing something that no other has before us. Which includes bringing the full power of the Native American Voice to bare upon the wrongs that have inflicted great harm upon our Indian and Public Trust Resources.

  1. Are Wildlife considered a public resource under the trusts?

Answer:

  1. Wildlife is a public resource. In the Unites States, wildlife is considered a public resource, independent of the land or water where wildlife may live. Government at various levels have a role in managing that resource on behalf of all citizens and to ensure the long-term sustainability of wildlife populations.
  2. Markets for game are eliminated Before wildlife protection laws were enacted, commercial operations decimated populations of many species. Making it illegal to buy and sell meat and parts of game and nongame species removed a huge threat to the survival of those species. A market in furbearers continues as a highly regulated activity, often to manage invasive wildlife.
  3. Allocation of wildlife by law. Wildlife is a public resource managed by government. As a result, access to wildlife for hunting is through legal mechanisms such as set hunting seasons, bag limits, license requirements, etc.
  4. Wildlife can only be killed for a legitimate purpose. Wildlife is a shared resource that must not be wasted. The law prohibits killing wildlife for frivolous reasons.
  5. Wildlife species are considered an international resource. Some species, such as migratory birds, cross national boundaries. Treaties such as the Migratory Bird Treaty and CITES recognize a shared responsibility to manage these species across national boundaries.
  6. Science is the proper tool for discharge of wildlife policy. In order to manage wildlife as a shared resource fairly, objectively, and knowledgeably, decisions must be based on sound science such as annual waterfowl population surveys and the work of professional wildlife biologists.
  7. The democracy of hunting. In keeping with democratic principles, government allocates access to wildlife without regard for wealth, prestige, or land ownership.

With Wildlife being considered now by our Federal government as a “Trust Resource” We can properly defend the treatment of those very resources using the Indian and Public Trusts. We no longer have to prove that they are a resource, that definition has been defined for us by the Federal Government.

We have the Attorneys now. We need your help to Employ these Very Attorneys….  They are very skilled, dedicated, as well as driven to speak for our Native American Trust Resources. They have litigated for The Sea Shepherd and Captain Paul Watson. Have been in the Federal System for a number of Years defending water, as well as the Environment.

We have set up regular phone conferences with Our Attorneys, encouraging other legal minds to Join Us in this all out War on Our Wildlife.

Most Large Orgs have refused to support our Voice up till now. If they continue to refuse, they will get left behind simply because our Wildlife can not wait for them to put the focus back to where it belongs which is in fact using the best tools available to them to speak out for them.

Erik Molvar Western Watersheds Project is not afraid to tell you why he has Joined us… Id suggest asking him why yourself if you are curious. Basically he has joined us because we have tools available to us that he does not, nor will ever have. He does however hold the same fire to defend our Wildlife, and thus far in joining us has kept his focus on exactly what we speak of…. OUR WILDLIFE. Together with Western Watersheds Project, alone with them if necessary we will celebrate with Ceremony our success after reaching our ultimate end goal of becoming the “Howl” that will be heard around the World.

Deidre Bainbridge, Attorney in Jackson Wyoming has also Joined our Ranks after participating in Yesterdays beginning telephone conference along with Alaska Inter-Tribal Councils Chief Environmental Officer Nikos Pastos. Along with others whom will remain anonymous at this point for good reason.
